Terms of Service

1. Acceptance of Terms

By accessing or using Komitly ("the Service"), including our desktop application and website, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Service Description

Komitly is a desktop Git client that provides a graphical interface for managing Git repositories. The Service includes a free tier and paid premium features. Komitly interacts with your local Git repositories and, optionally, remote hosting services such as GitHub and Bitbucket.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account and promptly update it if it changes.

4. Subscriptions & Billing

Premium features require a paid subscription. Prices are listed on our pricing page and may change with reasonable notice. Subscriptions renew automatically unless canceled before the renewal date. Payments are processed securely by Stripe. Refunds are handled in accordance with our refund policy and applicable law.

5. Free Tier & Premium Features

Komitly offers a free tier with core Git functionality. Certain advanced features, including AI-powered commits and integrations, require a premium subscription. We reserve the right to modify which features are included in each tier with reasonable notice.

6. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the application
• Use the Service to violate any applicable law or regulation
• Attempt to gain unauthorized access to the Service or its systems
• Redistribute, sublicense, or resell the Service without authorization
• Interfere with or disrupt the integrity or performance of the Service
• Circumvent or manipulate the licensing or entitlement system

7. Intellectual Property

The Service, including its design, code, and branding, is owned by Komitly and protected by intellectual property laws. Your use of the Service does not grant you ownership of any intellectual property rights in the Service. You retain all rights to your own code and repositories.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. Komitly does not access the contents of your repositories. Account and usage data is collected only as necessary to provide and improve the Service.

9. Third-Party Services

Komitly may integrate with third-party services such as GitHub, Bitbucket, OpenAI, and Anthropic. Your use of these integrations is subject to the respective third-party terms. Payment processing is handled by Stripe and subject to the Stripe Services Agreement. Komitly is not responsible for the availability, accuracy, or practices of third-party services.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, Komitly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. In no event shall our total liability exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, but provisions that by their nature should survive will remain in effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

14. Changes to Terms

We may update these terms from time to time. We will notify you of material changes by posting the updated terms on our website. Continued use of the Service after changes constitutes acceptance of the revised terms.
